Bankruptcy Process
At Diaz & Larsen, P.L.L.C., our goal is to simplify the bankruptcy process as much as possible. The following is an outline of the steps you can typically expect when you come to our office to discuss your bankruptcy:
Consultation
We offer a free initial consultation. This allows us to discuss both Chapter 7 and Chapter 13 bankruptcies with you, inform you of the differences between the two, the costs involved with both, and how you can qualify for each type. Once we have determined the appropriate type of bankruptcy for your situation, we will begin the paperwork process and set a return packet appointment.
Return Packet
At our next appointment, we will go over the documents that we need to make the filing. We will discuss any other questions you may have and set a date to file your bankruptcy. The filing date depends largely on you filling out the paperwork, providing all necessary information, and which type of bankruptcy you are qualified to file.
Filing
Once we receive all the necessary information from you, it is time to file your bankruptcy. If it is a joint filing, both parties must be present at the filing. At this time, you must provide copies of bank statements showing the balances of all open accounts as of the date of filing (for Chapter 7 and 13, these copies must show less than $100.00 total for all bank accounts). We will go over the bankruptcy documents, you will sign them, and we will obtain a case number.
Once you file, an automatic stay takes effect. This means your creditors must stop trying to collect on the debts.
341 Creditor/Trustee Meeting
After filing for bankruptcy, you will receive notice of a 341 meeting. You must attend this meeting, where you will meet your Bankruptcy Trustee and creditors. The following items must be brought to this meeting: most recent pay-stubs, picture ID, and social security card, W2, or passport. It is important to note that in a Chapter 7 bankruptcy, any tax refunds you may be entitled to go to your Trustee to pay your creditors.
Confirmation (Chapter 13 Only)
If you have filed a Chapter 13 bankruptcy, the final step is confirmation of your repayment plan. After the 341 meeting, we will resolve any objections your creditors may have and attend the confirmation hearing, if one is necessary. Once confirmation is complete, you will have to continue to make monthly payments on the 25th of each month for three to five years.
